Jalat Khan alias Jalo V. The State,

PCrLJ 2020 503 · Balochistan High Court

This case involved Jalat Khan, who was convicted and sentenced for the murder of the complainant's brother, allegedly shot while the complainant's cousin survived the attack. He appealed to the Balochistan High Court against his conviction and death sentence, which the trial court had referred for confirmation.

The High Court overturned the conviction and acquitted the accused, finding the prosecution's case riddled with doubt. The three eyewitnesses were all close relatives of the deceased, yet behaved unnaturally: they did not rush the victim to hospital, did not accompany the body, did not raise an alarm, and were not even named in the initial police report. There was an unexplained two-and-a-half hour delay in filing the FIR, and witness statements were recorded late without justification. Medical evidence describing a "hard and blunt" weapon contradicted the prosecution's firearm theory. The recovered rifle was found in a stranger's house with no connection to the accused, and crucially, the weapon and bullet casings were not sent to the forensic laboratory until eight months after recovery, undermining the reliability of the forensic report. Two key witnesses who could have supported the prosecution's version were never produced in court.

The court held that when related witnesses' testimony is not corroborated by surrounding circumstances or natural conduct, it can be discarded. Given these cumulative doubts, the accused was given the benefit of the doubt and acquitted, illustrating how procedural delays and inconsistencies can defeat even serious criminal charges.
