Zafar Iqbal V. The Judge Accountability Court-I, Balochistan, Quetta and another,

PCrLJ 2020 486 · Balochistan High Court

This case involved Zafar Iqbal, who was convicted under section 31-A of the National Accountability Ordinance, 1999, for allegedly absconding to avoid arrest in a corruption reference filed by NAB. He was accused of being a benamidar (frontman) for another individual in an accountability case. Because he did not appear in court, the trial court declared him an absconder and convicted him in his absence, sentencing him to three years imprisonment.

Iqbal appealed, arguing his conviction was improper because he lived in Punjab, but the notice of proceedings was published only in a Quetta newspaper, with no proof it reached him or was circulated nationally or in his home province. There was also no evidence that arrest warrants had actually been served on him, and no separate charge had ever been formally framed against him for the specific offence of wilful absconding, nor was evidence led to prove he deliberately evaded the court.

The Balochistan High Court accepted the appeal, holding that convicting someone without framing a charge and without giving them a chance to cross-examine evidence violates basic fair trial rights guaranteed under Articles 9, 10, and 10-A of the Constitution. Citing Supreme Court precedent, the court ruled that trials conducted in absentia without due process are unconstitutional. This case reinforces that even accountability courts must follow fair trial safeguards before conv
