Fazal Khan and 2 others V. Additional Sessions Judge/Model Criminal Trial Court, Barkhan at Rakhni and another,
PCrLJ 2020 422 · Balochistan High Court
This case is about whether false testimony given by prosecution witnesses in a murder trial should be punished. A man was killed, and an FIR was lodged accusing several people of murder. After a full trial, the Additional Sessions Judge acquitted the accused, and separately ordered that a Magistrate initiate proceedings against three prosecution witnesses for giving false evidence, an offence under sections 193, 194 and 195 of the Pakistan Penal Code.
The witnesses (through the complainant and others) then approached the Balochistan High Court, asking it to use its special inherent powers under section 561-A of the Criminal Procedure Code to quash the trial court's order and stop the Magistrate's proceedings against them.
The High Court refused. It held that these inherent powers cannot be used to override clear legal provisions, and can only be invoked to prevent misuse of court processes or to secure justice, not routinely whenever someone claims evidence was false. It also rejected the old legal principle that if a witness lies about one part of their testimony, all of it must be disbelieved, saying this idea does not fit Pakistan's legal or Islamic framework, since lying under oath is itself a serious crime with penal consequences. The court found the trial judge was right to refer the matter for prosecution of the witnesses, and dismissed the petition seeking to stop that action.
