Messrs City Marketing Service and 2 others V. The State,
PCrLJ 2020 402 · Balochistan High Court
This case is about who can be criminally prosecuted when a substandard or spurious drug is found being sold. Drug inspectors recovered a substandard cough syrup (XAMOL) from a medical store, which had been supplied by City Marketing Service, the distributor, under a written warranty from the actual manufacturer, Macquin's International Pharmaceutical Manufacturers of Karachi. The distributor and its associates were put on trial under the Drugs Act, 1976, even though the manufacturer itself was never prosecuted.
The Balochistan High Court held that under the Drugs Act, a distributor who is not the manufacturer or the manufacturer's agent cannot be held liable for a defective drug if it relied on a proper written warranty from the manufacturer confirming the drug's compliance with the law. The liability of the manufacturer and its distribution agent is meant to be joint, but since the manufacturing company was never charged, the distributor alone could not be convicted. The court found there was no possibility of conviction even if the trial continued, so it quashed the pending proceedings against the distributor and its owners and acquitted them.
This judgment matters because it clarifies that distributors who act on a manufacturer's warranty are legally protected from prosecution, and that authorities must pursue the actual manufacturer responsible for a defective drug rather than only the seller or distributor down the supply chain.
