PCrLJ 2020 338 · Balochistan High Court
This case involved a bail cancellation request in a criminal matter from Balochistan. The complainant alleged that the accused men had tried to forcibly take their uncle away while he was at a NADRA van getting his identity card processed. When the complainant and others intervened, one accused allegedly opened fire, injuring the complainant's ankle, while others beat him with fists and kicks. The accused were charged under sections of the Pakistan Penal Code including attempted murder (324), rioting, and acting with common intent. After their arrest, a trial court granted them bail, and the complainant then asked the High Court to cancel that bail.
The High Court refused to cancel the bail. It reasoned that cancelling bail requires much stronger grounds than granting it in the first place, since courts are reluctant to take away someone's liberty once bail has already been given, unless the original decision was clearly wrong or illegal. Here, the judge noted the accused fired only one shot, did not continue shooting when the victim was helpless, and the injury was not to a vital body part — suggesting no clear intent to kill. Since investigation was complete, no additional evidence needed recovering, and there was no misuse of the bail, the court found no reason to interfere.
This case illustrates the legal principle that bail, once granted, should not be revoked lightly, and matters like intent and exact criminal charges are to be sorted out at trial, not through bail cancellation.

ہائی کورٹ نے ضمانت منسوخ کرنے سے انکار کر دیا۔ عدالت نے وضاحت کی کہ ضمانت منسوخ کرنے کے لیے ضمانت دینے کی نسبت ک
