Ghulam Muhammad and another V. The State,

PCrLJ 2020 264 · Balochistan High Court

This case involved two men, Ghulam Muhammad and another appellant, who were convicted by a trial court in Mastung for possessing narcotics under the Control of Narcotic Substances Act, 1997. Levies personnel had stopped their motorcycle at a checkpoint and allegedly recovered packets of charas (cannabis) weighing several kilograms, hidden in the vehicle's saddlebags. Based on this recovery, both men were sentenced to eight years' rigorous imprisonment plus fines.

On appeal, the Balochistan High Court examined the forensic evidence closely. It found that the Government Analyst's report, which was central to proving the substance was actually a narcotic, did not comply with mandatory rules requiring full protocols and test details to be documented. Without this, the report had no real evidentiary value. The court also noted that the prosecution failed to produce the process-server who supposedly carried the drug samples to the laboratory, meaning there was no proof the samples were safely and reliably transmitted without tampering or mix-up.

Relying on Supreme Court precedents, the High Court held that these gaps created serious doubt about the prosecution's case. Since the benefit of doubt in criminal cases must go to the accused, the court allowed both appeals and set aside the convictions.

This judgment matters because it reinforces that narcotics convictions cannot rest on incomplete or improperly verified laboratory reports, protecting individuals from wrongful convictions based on weak forensic and chain-of-custody evidence.
