Muhammad Raheem V. The State,

PCrLJ 2020 192 · Balochistan High Court

This case is about a man convicted for allegedly evading arrest, under a special anti-terrorism law provision (Section 21-L of the Anti-Terrorism Act, 1997), which punishes someone who deliberately hides or avoids court proceedings to obstruct justice.

The appellant was not originally named in the FIR (the initial police complaint) about a violent armed attack that killed two people and caused other serious harm. He was only implicated later, after the main accused were tried and mostly acquitted, when the complainant filed a supplementary statement naming him. The trial court then declared him a proclaimed offender and convicted him in his absence, without ever formally charging him with the specific offence of evading arrest, and without holding the legally required inquiry into whether his absence was truly deliberate.

The Balochistan High Court found this process deeply flawed. The law requires courts to properly investigate and prove that an accused deliberately absconded before convicting them in absentia. Since no such charge was framed, no evidence of willful absconding was presented, and the complainant himself knew the appellant lived elsewhere, the court held that his fundamental rights to a fair trial and due process (under Articles 9, 10, and 10-A of the Constitution) were violated.

The court set aside the conviction and sent the case back for retrial, reinforcing that even in terrorism cases, basic fair trial safeguards cannot be bypassed.
