Bahlol Khan Kasi V. Azmatullah Kasi and another,

PCrLJ 2020 1633 · Balochistan High Court

This case involved a criminal appeal against an acquittal arising from a 2012 incident in Quetta. The complainant alleged that during an engagement ceremony, the accused abused and threatened his brother, then opened fire, injuring the brother and two other relatives. An FIR was registered, but after trial, the accused was acquitted, prompting the complainant to appeal.

The Balochistan High Court upheld the acquittal. It found serious inconsistencies in the prosecution's evidence: witnesses who were closely related to the complainant gave accounts that conflicted with those of independent, impartial witnesses, and the injuries described did not match the medical evidence, such as missing blackening or exit wounds expected from close-range firing. The court also noted that the accused had separately filed his own FIR about the same incident, suggesting it was actually a chaotic mutual brawl rather than a one-sided attack, making it unsafe to rely on the complainant's version.

Importantly, the court also ruled that the complainant himself was not injured in the incident, so under the law only an injured, aggrieved person could file an appeal against acquittal—not the complainant. Since the actually injured relatives did not appeal, the complainant's appeal was deemed legally incompetent.

The case highlights core criminal law principles: the prosecution must prove guilt beyond reasonable doubt, acquitted persons enjoy a double presumption of innocence, and only genuinely aggrieved parties can challenge an acquittal.
