Shahida Yasmin V. The State,
PCrLJ 2020 1536 · Balochistan High Court
This case from the Balochistan High Court involved a woman, Shahida Yasmin, whose late husband had stood as a surety (guarantor) for an accused person, Fazal Rehman, to secure his bail in a criminal case. As part of the surety arrangement, her husband deposited Rs. 50,000 in cash and submitted property documents.
After being released on bail, the accused later jumped bail and stopped appearing before the trial court. The husband who had acted as surety had already died before this happened. Despite his death, the trial court forfeited the full surety amount of Rs. 300,000. When the petitioner requested relief on humanitarian grounds, the trial court only reduced the forfeited amount by 25 percent, which she felt was insufficient, prompting her to approach the High Court.
The High Court ruled in her favor, relying on Section 514(6) of the Criminal Procedure Code, which clearly states that if a surety dies before the bond is forfeited, his estate is automatically discharged from all liability under that bond. Since the husband died before the accused absconded, the forfeiture proceedings themselves were invalid from the start.
The court declared the forfeiture order void and ordered the full cash deposit and property documents returned to the petitioner. This case reinforces that legal liability under a surety bond cannot survive the surety's death if it occurs before forfeiture, protecting the deceased's estate and heirs from such financial obligations.
