Muhammad Wali V. The State,

PCrLJ 2020 1442 · Balochistan High Court

This case involved Muhammad Wali, who was convicted by a trial court for possessing 10 kilograms of charas (hashish) under Pakistan's Control of Narcotic Substances Act, 1997, and sentenced to ten years in prison along with a fine. He appealed to the Balochistan High Court.

The police claimed they stopped a passenger van and found the drugs in a bag on the appellant's lap. However, the High Court found serious flaws in how the prosecution handled the case. First, although the arrest happened at 10:00 a.m., the police did not file the official report until six hours later, with no explanation for the delay. Second, and more critically, the drug samples were supposed to be sent to the government forensic laboratory within 72 hours under the relevant rules, but they were not received by the lab until eleven days later - again with no explanation. The prosecution also failed to present the official who personally carried the sample to the laboratory, so there was no way to verify who had custody of the evidence during that unexplained gap.

Because of these failures, the court could not be confident that the evidence had not been tampered with or that the chain of custody was reliable. Since any doubt in such cases must benefit the accused, the court ruled that the prosecution had not proven its case beyond reasonable doubt. The appeal was allowed, and the conviction and sentence were set aside. This case highlights how strict procedural rules around evidence handling in drug cases protect defendants from unreliable convictions.
