Juma Gul V. The State,

PCrLJ 2020 1350 · Balochistan High Court

This case is about the murder of Barat Khan, who was allegedly shot by Juma Gul during a quarrel while packing vegetables in an orchard. The trial court had convicted Juma Gul under Section 302(b) of the Pakistan Penal Code and sentenced him to death, along with a compensation order to the victim's family. Juma Gul appealed to the Balochistan High Court, and the case was also sent for confirmation of the death sentence.

On reviewing the evidence, the High Court found serious problems with the prosecution's case. Witnesses gave contradictory accounts, and it appeared the complainant may not even have been present at the scene. The site plan did not match witness testimony about where the shooting occurred, and no eyewitnesses were marked on it. Medical evidence about how close the shooter stood contradicted the physical findings on the body. The recovered weapon and bullet casing were never sent for forensic testing, weakening that evidence further. Additionally, blood-stained clothing was handed over to police two days after the incident, raising further doubts. The eyewitnesses were all close relatives of the deceased and had existing enmity with the accused, making independent corroboration necessary but lacking.

Given these unresolved doubts, the court ruled that the benefit of doubt must go to the accused, acquitting Juma Gul and overturning his death sentence. This case highlights the importance of consistent, corroborated evidence, especially in cases involving the death penalty and testimony from interested witnesses.
