M. Khalid Aziz V. The State through Director General NAB, Balochistan,

PCrLJ 2020 1291 · Balochistan High Court

This case was about whether a man convicted under Pakistan's anti-corruption law, the National Accountability Ordinance (NAB Ordinance), could get extra time to file his appeal after missing the deadline.

Khalid Aziz, a trader, was accused of colluding with others to fabricate shipping documents and customs paperwork, causing financial loss to the government and a foreign company. He admitted wrongdoing and agreed to voluntarily return around 10 million rupees in illicit gains, but he only paid part of it and kept delaying payment of the rest. He was eventually tried and, on 13 July 2015, disqualified from holding public office for ten years under the relevant provision of the NAB Ordinance after being released on the condition that he return the money.

The law required any appeal against such a decision to be filed within ten days, but Aziz filed his appeal two months late, claiming he was too ill to travel and file on time.

The Balochistan High Court rejected this excuse, noting he was present in court when the judgment was announced, suggesting the delay was deliberate. More importantly, the court ruled that because the NAB Ordinance sets its own specific appeal deadline, the general law allowing courts to excuse delays for good reason (Section 5 of the Limitation Act) does not apply here, due to another provision (Section 29(2)) of the same law. The court therefore refused to excuse the delay and dismissed the appeal, reinforcing that strict, non-extendable deadlines apply to NAB appeals.
