PCrLJ 2020 1255 · Balochistan High Court
This case involved a man convicted for allegedly possessing twenty liters of alcohol in violation of the Prohibition (Enforcement of Hadd) Order, 1979. He was originally sentenced by a Magistrate to two years imprisonment plus a fine, and on appeal an Additional Sessions Judge reduced the sentence to one year. The man then challenged his conviction before the Balochistan High Court through a criminal revision petition.
The High Court found serious flaws in how the prosecution handled the case. The alcohol sample reached the forensic laboratory seven days after seizure, with no explanation of where it was kept or who had custody of it during that time. The police official who actually transported the sample to the lab was never produced as a witness to confirm it hadn't been tampered with. Additionally, the witnesses gave contradictory accounts of basic facts, such as when the investigating officer arrived at the scene and who prepared the sealed sample parcels.
Relying on Supreme Court precedents, the High Court held that when the chain of custody of evidence is broken or unexplained, the forensic report becomes unreliable and cannot support a conviction. The court also reaffirmed the principle that legal procedures must be followed exactly as prescribed, or they are considered not followed at all.
As a result, the court accepted the revision petition and acquitted the accused, highlighting how failures in evidence-handling and witness reliability can undermine even seemingly straightforward criminal cases.
