Ali Muhammad V. The State,
PCrLJ 2020 1104 · Balochistan High Court
This case involved an appeal by Ali Muhammad, who had been convicted by a trial court in Lasbela and sentenced to life imprisonment for murder, after being accused along with a co-accused of shooting the complainant's brother and injuring his cousin. The Balochistan High Court overturned the conviction and acquitted him, finding the prosecution's evidence riddled with doubt.
The court identified multiple serious problems with the case. The eyewitnesses contradicted each other about who actually fired the shots, and their accounts of the incident did not match. One witness was not even mentioned in the initial police report, suggesting his testimony was added later to patch up the story. There was an unexplained three-hour delay in filing the police report, and the injured witness only sought medical treatment a week after the alleged shooting, despite supposedly having gunshot wounds, which the doctor did not confirm at the first point of contact. Medical evidence also conflicted with witness accounts of how the attack occurred. Additionally, the alleged murder weapon was recovered 19 days after the incident, and it took 24 days to send it for forensic testing, raising serious doubts about its authenticity as evidence. Since a co-accused with a similar alleged role had already been acquitted and not challenged, the court found it unjust to convict this appellant on the same weak evidence.
This case reinforces the principle that even a single reasonable doubt must benefit the accused, and that prosecutions must independently prove their case beyond doubt, not rely on shaky, contradictory evidence.
