Mohibullah V. The State,
PCrLJ 2020 1039 · Balochistan High Court
Mohibullah was convicted by a trial court in Pishin for the murder of Zainullah and for causing serious injuries to Muhammad Ashraf during an attack near a petrol pump, allegedly carried out along with two other men armed with daggers and sticks. He was sentenced to life imprisonment for murder, plus additional jail terms and fines for the injuries caused, under relevant sections of the Pakistan Penal Code. He appealed his conviction, while the complainant separately sought enhancement of his sentence.
The Balochistan High Court examined the evidence, including testimony from an independent eyewitness unrelated to the complainant, and from the injured victim himself, both of whom supported the prosecution's account of events. The court noted that although the complainant himself was not present during the attack and had only lodged the FIR based on information received by phone, this did not weaken the case, since his role was simply to report the crime, not to witness it. The court also held that failing to name the eyewitness in the FIR did not make the prosecution's case doubtful.
Finding that the accused and his companions had arrived at the scene armed and acted with shared intent, the court ruled that the prosecution had proven its case beyond reasonable doubt. It upheld the trial court's conviction and sentence, dismissing the appeal. This case illustrates how courts assess witness credibility and procedural technicalities like FIR omissions when deciding serious criminal cases.
