Muhammad Ayub and others V. The State,

PCrLJ 2019 1731 · Balochistan High Court

This case involved seven appeals arising from a corruption scandal in Balochistan's education department. Government officials, including the District Education Officer and Deputy District Education Officer of Pishin, were accused of making 39 fake teacher appointments and misappropriating government funds. They were charged with criminal breach of trust, cheating, forgery, and misconduct under the Pakistan Penal Code and the Prevention of Corruption Act. After trial, the Special Judge Anti-Corruption convicted and sentenced them to lengthy prison terms, fines, and recovery of over 87 lakh rupees in misappropriated funds.

On appeal, the Balochistan High Court found a serious procedural flaw: when the trial court questioned the accused under Section 342 of the Criminal Procedure Code (which requires courts to give accused persons a chance to explain evidence against them), it failed to properly put all the incriminating evidence to them. Important pieces of evidence, such as inquiry reports, statements of absconding co-accused, and specimen signatures, were relied upon by the trial court for conviction without ever being specifically put to the accused for their response.

The High Court held this was mandatory, not optional, under the law, and that evidence not put to the accused in this manner cannot be used to convict them. Because this requirement was violated, the court set aside the convictions and sent the case back to the trial court to properly re-record the accused's statements. This case highlights the importance of fair procedure and an accused person's right to respond to evidence before being convicted.
