Baboo V. The State,

PCrLJ 2019 1618 · Balochistan High Court

This case is about a bail application in a murder case from Balochistan. A man named Saleh Muhammad disappeared and was later found dead near a highway. Footprints near the body led towards the house of the applicant, Baboo, who was then charged with murder along with others under the Pakistan Penal Code. There was a history of tension between the two, as the deceased had earlier filed a complaint against Baboo before a magistrate.

Baboo sought bail, arguing there were no eyewitnesses, nothing was recovered from him, and the case against him was weak and based on suspicion rather than solid evidence. The Balochistan High Court agreed. It noted the crime occurred at night with no witnesses, that fingerprints on the recovered weapons (iron rods and sticks) were never examined despite being available, and that there was a contradiction between the medical evidence (showing sharp-weapon injuries) and the weapons actually recovered (blunt objects). The court also held that an alleged confession made to police was not legally admissible since no new evidence was discovered because of it.

Given these weaknesses, the court ruled the case needed further inquiry and granted bail, emphasizing the legal principle that even courts hearing ongoing trials can grant bail if the accused qualifies, and that wrongly detaining an innocent person can never truly be undone.
