Nazar Muhammad and others V. The State and others,
PCrLJ 2018 Note 106 · Balochistan High Court
This case involved a dispute over the alleged sale of vehicles. The complainant claimed he sold several vehicles, including a pick-up truck and two cars, to a father and his sons for over Rs. 47 lakh. He said he received partial payment plus a car in exchange, but the four cheques given for the remaining balance bounced when presented at the bank. He filed a criminal case accusing the buyers of cheating and dishonestly issuing bad cheques under the Pakistan Penal Code.
At trial, one accused, Nazar Muhammad, was convicted and sentenced to two years, while the other three family members were acquitted. Both sides then approached the Balochistan High Court: the convicted man sought to overturn his conviction, the complainant appealed the acquittals and also sought a harsher sentence.
The High Court examined the evidence closely and found major gaps. The complainant could not produce any documents proving the vehicle sale ever took place, gave no vehicle details, and had inconsistent testimony about where the deal happened. The bank confirmed cheques were dishonoured due to mismatched signatures, but no fraudulent intent was proven.
The court held that simply issuing a cheque that bounces is not enough to prove the crime of dishonest cheque issuance; deceitful intent must be shown. Since the prosecution failed to prove any genuine transaction existed, the court acquitted Nazar Muhammad too, setting aside his conviction, and rejected the complainant's appeals.
