Sadullah V. The State,
PCrLJ 2018 999 · Balochistan High Court
This case involved the murder of a man named Khalil, who was shot outside a courthouse in Chaman on 14th May 2014 while going to inquire about a court hearing. His brother, the complainant, and cousins witnessed the shooting from a nearby car. The accused, Sadullah, along with two co-accused (who were declared proclaimed offenders and tried separately), allegedly ambushed the victim with pistols, firing shots that proved fatal. The trial court convicted Sadullah under section 302(b) of the Pakistan Penal Code for murder with common intention, sentencing him to life imprisonment and ordering compensation to the victim's family.
Sadullah appealed his conviction, while the complainant filed a separate petition seeking the death penalty instead of life imprisonment. The Balochistan High Court examined the evidence, including eyewitness testimony from relatives of the deceased, medical evidence confirming death from firearm injury to the brain, forensic reports, and recovered weapons and bloodstained items. The court held that eyewitness accounts were credible despite being relatives, since it made no sense that real family members would falsely accuse innocent people while protecting the actual killers. The court also found sufficient evidence of common intention among the attackers.
The court dismissed both the appeal against conviction and the complainant's request for a harsher death sentence, ruling that since the main fatal shots were attributed to an absconding co-accused rather than Sadullah himself, this was a valid mitigating factor justifying life imprisonment rather than death.
