PCrLJ 2018 954 · Balochistan High Court
This case involved several petitioners whose domicile certificates had been cancelled by Deputy Commissioners in different districts of Balochistan. These certificates matter because people rely on them to claim jobs and admissions to educational institutions under the quota system for various districts and departments. The petitioners argued that the authorities cancelled their certificates without following the proper legal procedure set out in the Pakistan Citizenship Act, 1951 and the Citizenship Rules, 1952, and that officials wrongly confused two separate concepts: domicile and permanent residence.
The Balochistan High Court, sitting as a larger bench to settle recurring confusion on this issue, clarified that domicile is a legal status that does not automatically change just because a person moves to another province to live there permanently, whereas permanent residence is simply a factual matter of where someone lives. The court held that domicile certificates can only be cancelled by following the specific procedure under Rule 26 of the 1952 Rules, including proper inquiry, especially since cancellation on grounds of fraud or misrepresentation carries serious consequences, potentially amounting to a denial of a person's citizenship rights. Since the authorities had cancelled the certificates without holding proper inquiries, the court set aside those cancellation orders and restored the petitioners' domicile certificates. This ruling matters because it protects citizens from having such important rights taken away arbitrarily, without due process.
