Khair Muhammad Shah V. The State,

PCrLJ 2018 914 · Balochistan High Court

This case is about a man convicted of causing another person's death by driving an oil tanker recklessly. In 2015, a truck driver, Khair Muhammad Shah, was involved in a road accident at Hub Bridge in Balochistan that killed a motorcyclist named Shafi Muhammad. Police charged him with rash and negligent driving that led to death, along with related offenses, and a trial court convicted him, sentencing him to one year in prison and ordering him to pay compensation (diyat) to the victim's family.

The accused appealed to the Balochistan High Court, arguing there was no real evidence that he had driven carelessly and that the accident might have resulted from the deceased's own actions, since the motorcycle was reportedly overloaded with goods at the time.

The High Court examined the evidence and found a major weakness: the only prosecution witness, the victim's uncle, had not actually witnessed the accident himself and arrived only after it happened. He could not explain how or why the crash occurred, and there was no other proof of reckless driving. The court held that a conviction cannot rest on guesswork or assumptions, and that the prosecution must prove guilt beyond reasonable doubt.

Because the evidence left real doubt about who was at fault, the court gave the benefit of that doubt to the accused, overturned his conviction, and acquitted him. The case highlights the importance of solid eyewitness evidence and the principle that suspicion alone cannot justify a criminal conviction.
