Ali Bakhsh alias Ali dost V. The State,

PCrLJ 2018 866 · Balochistan High Court

This case involved Ali Bakhsh, who was convicted by a trial court for attempted murder and causing injury (hashimah) under Pakistan's Penal Code, after allegedly shooting his cousin's associate, Umid Ali, following an old dispute over harsh words exchanged a month earlier. He was sentenced to five years' imprisonment along with fines and compensation (daman) to the victim.

On appeal, the Balochistan High Court closely examined the prosecution's evidence and found it riddled with inconsistencies. The complainant did not witness the shooting himself and gave contradictory, vague accounts about how and when he learned of the incident. The FIR was lodged suspiciously fast, before timelines given by the complainant made sense. Key witnesses could not justify their presence at the scene, contradicted each other, and appeared to be giving false testimony due to their relationship with the victim. No independent witnesses supported the prosecution's version. Medical records confirming treatment were never produced, and the forensic report on recovered cartridges was delayed and did not even match the actual case evidence, making it worthless.

Given these serious gaps and contradictions, the court ruled that the prosecution failed to prove the charges beyond reasonable doubt. Following established legal principles that benefit of doubt must go to the accused, the High Court set aside the conviction and sentence, acquitting Ali Bakhsh.
