Azeem Khan and 2 others V. The State and another,
PCrLJ 2018 726 · Balochistan High Court
This case involved a murder near Killa Saifullah, Balochistan, where a man named Mehboob Khan was shot dead while traveling home with relatives. The complainant alleged that two accused men attacked the group, one engaging in a physical fight while the other, Azeem Khan, pulled out a pistol and shot the victim, who later died in hospital. A third person was also tried as a co-accused for allegedly sharing the common intention to commit the crime. The trial court had convicted the accused and sentenced them to death.
On appeal, the Balochistan High Court examined the eyewitness testimony, medical evidence, and forensic reports. It found the ocular evidence credible and consistent, supported by medical findings of a gunshot wound and by forensic matching of recovered cartridges to the pistol seized from the accused. The court held that being related to the victim did not automatically discredit the witnesses, since their accounts were reliable and corroborated.
However, the court found that the prosecution had failed to prove the alleged motive (old enmity), which it treated as a mitigating factor, and reduced the death sentence to life imprisonment for the main accused. For the co-accused allegedly sharing common intention, the court found no evidence of any overt act, weapon, or instigation, and acquitted him, giving him the benefit of the doubt.
This case highlights how Pakistani courts weigh eyewitness, medical, and forensic evidence together, and how failure to prove motive can reduce punishment even when guilt is otherwise established.
