Khair Muhammad was tried for shooting and killing Younas Masih over a dispute about payment for medical treatment. Masih had treated the accused for piles; when he later asked for money to buy medicine ingredients, the accused left, then confronted him the next morning near his house and shot him. Masih's sons heard the gunfire, saw the accused fleeing with a pistol, and their father told them what happened before dying in hospital. Based on this, the trial court convicted the accused under section 302(b) of the Pakistan Penal Code and sentenced him to death, plus compensation to the victim's heirs.
On appeal, the Balochistan High Court upheld the conviction and death sentence. The court found that minor contradictions in witness statements were not serious enough to create doubt about the prosecution's case. The eyewitness account from the victim's sons matched the medical evidence and recovered items like bullet casings and blood-stained articles. Being relatives of the deceased did not automatically make their testimony unreliable, since cross-examination did not reveal any false implication due to enmity or grudge. The court also held that lack of a clear motive did not matter given strong eyewitness evidence, since motive and intent are different things. It ruled the killing was premeditated, not a sudden reaction, so there were no grounds for a lesser sentence. The court reaffirmed that death is the normal punishment for murder unless there are good reasons to reduce it, and dismissed the appeal, confirming the death sentence.
