This case involved the murder of a woman, allegedly killed by her husband with help from his brother. The prosecution's theory was that the husband strangled his wife and then staged the scene to make it look like she had hanged herself, concealing the true cause of death.
At trial, several witnesses testified, including the deceased's brother, her two sons, and her sister. They described a troubled marriage marked by ongoing physical abuse and threats against the deceased. One witness had even recorded a conversation in which the deceased described the torture she suffered. An independent witness placed the husband at the scene around the time of the killing. Medical evidence showed a two-inch wound on the deceased's neck caused by a sharp weapon, dust in her hair suggesting her body had been dragged, and a determination that death resulted from suffocation and homicide rather than suicide. The husband claimed his wife had killed herself due to depression, but he offered no explanation for his own suspicious behavior after finding her body, such as failing to question witnesses, involve her family, contact police, or arrange her funeral.
The High Court found the circumstantial and medical evidence, along with the husband's unnatural conduct, sufficient to uphold his conviction for murder. However, it acquitted the brother, ruling that no direct or indirect evidence proved he shared a common intention or participated in the killing. The judgment highlights how courts weigh circumstantial evidence, medical findings, and a suspect's behavior after a crime in murder cases, while insisting on distinct proof of guilt for each accused person.
