This case from the Balochistan High Court dealt with allegations of fraud involving fake Computerized National Identity Cards (CNICs) and passports obtained by Afghan nationals to travel abroad. The FIA had arrested Muhammad Asif after finding him with 18 smart CNICs, a photocopy of another CNIC, and birth certificates, believed to be linked to an agent scheme that helped foreigners fraudulently acquire Pakistani identity documents and passports for onward travel to countries like Australia and Europe. Several people, including Asif, Danish Ali, Syed Asad Kazmi, and Rahim alias Inayatullah, were convicted by the trial court on charges of cheating, forgery, using forged documents, violating the NADRA Ordinance, the Foreigners Act, and corruption laws.
On appeal, the High Court reviewed the evidence carefully. It found that the prosecution could not locate or produce most of the individuals in whose names the CNICs were issued, and no proper forensic examination had been done to prove the documents were fake. Because of these gaps, the court ruled that guilt had not been proven beyond reasonable doubt for most of the accused, and acquitted them, giving them the benefit of the doubt.
However, one accused person had directly confessed to being an Afghan national who paid heavily to obtain a fake Pakistani CNIC and passport, and this evidence was solid. His conviction was upheld, and his appeal was dismissed.
