This case is about a criminal revision petition filed by Muhammad Siddique challenging his conviction for kidnapping and sodomy. According to the prosecution, in June 2015, Siddique and a co-accused forcibly took a 12-year-old boy on a motorcycle from a market and brought him to a room near a fisheries pond, where they and another unidentified man sexually assaulted the child overnight before releasing him the next day. The boy's father filed a police report once his son returned home and explained what happened. Both the trial court and the appellate court had convicted Siddique and his co-accused under Pakistan's Penal Code sections dealing with kidnapping and unnatural offences (sodomy), sentencing them to prison terms and fines.
The Balochistan High Court reviewed the evidence and upheld the conviction. It found that the testimony of the father and the victim was consistent, detailed, and unshaken even after lengthy cross-examination, and was backed up by medical evidence confirming sexual assault. The court also addressed two common defense arguments: that a one-day delay in filing the police report should count against the case, and that testimony from a related witness (the father) should be less trusted. The court rejected both, ruling that such delays are natural given family embarrassment, and that a relative's testimony is credible unless there's proof of hostility or false motive. The court also confirmed that a victim's own credible testimony alone can be enough to convict in such cases. The petition was dismissed, and the conviction stood.
