Abdul Wasay and another V. The State and others,

PCrLJ 2018 148 · Balochistan High Court

This case involved a criminal appeal, a state appeal against an acquittal, and a murder reference before the Balochistan High Court, all arising from the same trial court judgment.

The incident occurred in 2012 when the complainant and his brother were confronted near a checkpoint by several accused men, following a land dispute. After an initial altercation, the complainant's party went to a hospital, where they were attacked again. During this second attack, the accused Abdul Wasay allegedly stabbed the complainant's son repeatedly with a knife, killing him, while another accused stabbed the complainant's brother. Two other co-accused allegedly beat the complainant with fists and kicks.

The trial court had convicted Abdul Wasay and sentenced him to death, while acquitting three co-accused. Various parties appealed: the convicted man challenged his conviction, the complainant challenged the acquittals, and the case was also referred for confirmation of the death sentence.
