Hassan Gul V. The State,

PCrLJ 2018 1032 · Balochistan High Court

This case is about an appeal against a death sentence handed down by a trial court in Balochistan. The appellant, Hassan Gul, had been convicted of murder and attempted murder after he and co-accused, armed with automatic weapons, allegedly opened fire on the complainant's group, killing one person and wounding another with multiple gunshot injuries.

The High Court examined the evidence, including eyewitness accounts from the complainant and the injured survivor, both of whom gave consistent and detailed testimony that withstood cross-examination. Medical evidence confirmed the gunshot injuries, and the court found no reason to doubt the witnesses simply because they were related to the victims or had a personal stake in the case, since their accounts were credible and corroborated each other. The court also ruled that failure to recover the murder weapon did not weaken the prosecution's case, since direct eyewitness evidence was sufficient, and the accused had time to hide the weapon while he was a fugitive.

However, the court found that the trial court had been too harsh in imposing the death penalty, ignoring that there was a pre-existing land dispute and litigation between the parties, which served as a mitigating factor. As a result, the High Court upheld the conviction but reduced the sentence from death to life imprisonment.

This case illustrates how appellate courts balance strict evidentiary standards with considerations of context and mitigating circumstances when reviewing capital punishment cases.
