Noor-Ud-Din and others V. National Database Registration Authority through Director General NADRA and others,

PCrLJ 2017 594 · Balochistan High Court

This case involved seven petitioners, mostly employees of Frontier Corps Balochistan and Pakistan Army, who wanted their dates of birth corrected in their Computerized National Identity Cards (CNICs). They claimed their correct dates of birth, as recorded in school and official service records, had been mistakenly entered incorrectly by NADRA when their CNICs were issued.

The petitioners had already tried several routes: they approached NADRA directly, filed civil suits (which were dismissed for lack of jurisdiction), filed earlier constitutional petitions before the same High Court (which they withdrew, intending to pursue other remedies), and filed appeals before the Balochistan Service Tribunal (which were not admitted). Having exhausted these attempts, they filed fresh constitutional petitions before the High Court.

The Balochistan High Court dismissed the petitions. It held that since the matter concerned terms and conditions of civil servants, the proper forum was the Service Tribunal, not the High Court's constitutional jurisdiction, which can only be invoked in exceptional circumstances. The court also noted the case involved disputed facts about the petitioners' actual dates of birth, unsuitable for constitutional proceedings. Crucially, since the petitioners had earlier withdrawn similar petitions without seeking permission to file fresh ones, procedural law (Order XXIII, Civil Procedure Code) barred them from filing new petitions on the same issue.
