Sanaullah V. The State,
PCrLJ 2017 568 · Balochistan High Court
This case involved a murder appeal before the Balochistan High Court. Sanaullah had been convicted by the trial court of murdering his relative Shah Nawaz and sentenced to death, after allegedly firing on him while the victim was traveling in a car with two relatives. The trial court relied on the victim's dying declaration, eyewitness testimony from the victim's brother and cousin, an alleged motive involving a dispute over Rs. 10 lakh demanded for a vehicle purchase, and recovery of the weapon used.
The High Court overturned the conviction, finding the prosecution's case riddled with doubt. Medical evidence showed the victim was unconscious upon arrival at the hospital, contradicting police claims that he gave a dying declaration afterward, suggesting it was fabricated. The eyewitnesses' account was also implausible: they claimed close-range firing through closed car windows, yet the glass was undamaged and neither witness was hit, despite being seated right next to the victim. The alleged motive was weak and unproven. Additionally, the weapon recovery was questionable since the empty cartridges and firearm were never sent for forensic testing.
Given these serious contradictions and the requirement that guilt be proven beyond reasonable doubt, the court held that the benefit of doubt must go to the accused. It set aside the conviction and death sentence, acquitting Sanaullah. This case reinforces the legal principle that even minor inconsistencies between evidence types can be enough to overturn a conviction, especially in serious cases carr
