Ali Bakhsh Baloch and others V. The State through D.G. NAB and others,
PCrLJ 2017 53 · Balochistan High Court
This Balochistan High Court case involved three government officials—Ali Bakhsh Baloch, Abdul Wali Kakar, and Asfand Yar Khan Kakar—who had earlier held positions as Secretary of Food, Director Food, and Provincial Minister for Food in the Balochistan government. They sought pre-arrest bail after the National Accountability Bureau (NAB) filed a reference accusing them, along with an official named Muhammad Haseen Khan Afridi, of being involved in the embezzlement of government wheat worth nearly 293 million rupees from grain storage centers in Chaman and Pishin. The alleged offences fell under provisions of the National Accountability Ordinance, 1999, dealing with misuse of authority and corruption.
The petitioners argued they were falsely implicated due to mala fide (bad faith) on the part of the authorities. However, the court found that their petitions did not specifically spell out any such mala fide intent, which is a strict legal requirement for granting anticipatory bail in such cases. Instead, the allegations against them concerned genuine misuse of authority, negligence, and failure to perform their official duties, which collectively resulted in large-scale embezzlement and heavy financial loss to the government.
Given the seriousness of the accusations and the absence of proven bad faith, the court refused to grant pre-arrest bail and dismissed all three petitions. The case underscores that public officials cannot easily avoid arrest in corruption cases merely by alleging mala fide without concrete evidence

درخواست گزاروں کا موقف تھا کہ انہیں حکام کی بدنیتی (مالا فائیڈ) کی بنا پر جھوٹے مقدمے میں ملوث کیا گیا ہے۔ تاہم عدالت نے پ
