Waqas Ali V. The State ,
PCrLJ 2017 445 · Balochistan High Court
Waqas Ali was convicted by a Special Judge in Quetta and sentenced to life imprisonment for allegedly possessing 275 kilograms of charas (cannabis) found in his vehicle, under Pakistan's Control of Narcotic Substances Act. He appealed to the Balochistan High Court.
The High Court overturned the conviction and acquitted him, finding serious flaws in how the police and laboratory handled the case. The contraband samples were sent for chemical analysis 1 month and 24 days after seizure, far exceeding the 72-hour limit required by law, with no explanation of how the samples were safeguarded in the meantime. The Chemical Examiner's report itself was legally defective, missing a required second signature, failing to describe the testing method used, and not naming the officer who delivered the samples. Police also failed to seal or separate samples at the scene, instead sending the entire seized quantity to the lab, which the court saw as an attempt to cover up procedural lapses. Additionally, prosecutors could not prove Waqas Ali actually owned the vehicle, and his mere presence in it was not sufficient to prove he knowingly possessed the hidden drugs.
This case matters because it reinforces that in serious narcotics cases carrying harsh sentences like life imprisonment, courts require strict, error-free compliance with legal procedures for evidence handling. Sloppy police work or defective forensic reports can result in acquittal, regardless of the quantity of drugs allegedly involved.
