Muhammad Hussain V. The Secretary, Government of Balochistan and 3 others,

PCrLJ 2017 409 · Balochistan High Court

This case involved a dispute over a government job in Balochistan. The petitioner's father, a Sepoy in the Federal Levies, died while in service in December 1996. The petitioner claimed that under Levies rules, he was entitled to be appointed to his late father's post, but instead another man, respondent No.4, was given the job in 1998. The petitioner did not challenge respondent No.4's appointment as improper on its own terms, but argued he had a preferential right to the post as the deceased employee's son.

The problem was that the petitioner waited 18 years after his father's death, and about the same length of time after respondent No.4's appointment, before filing this petition in court. The Balochistan High Court held that this enormous, unexplained delay amounted to "laches," a legal principle where courts can refuse to grant relief if someone sits on their rights for an unreasonably long time, especially when others have relied on the existing situation in the meantime. The court noted that respondent No.4 had by then served 18 years, creating a settled legal position that could not simply be undone. The petitioner offered no explanation for the delay, and other family members had already been accommodated with similar jobs elsewhere.

The court dismissed the petition, emphasizing that such long, unexplained delays in service-related disputes will generally defeat a claim, even if it might otherwise have merit.
