Balochistan Bus Owners Association (Regd.) through President V. Government of Balochistan Home and Tribal Affairs through Secretary and 4 others,

PCrLJ 2017 211 · Balochistan High Court

This case was about a dispute between the Balochistan Bus Owners Association and provincial authorities over restrictions on night-time bus travel along the N-65 highway connecting Quetta with Sibi, Nasirabad, Dera Murad Jamali, and onward to Sindh and Punjab. The bus owners argued that local administration and police had stopped their coaches from traveling after sunset at checkpoints in Kolpur and Dera Murad Jamali, citing security concerns, leaving passengers stranded overnight without food or shelter. They asked the court to direct the government to let them run buses according to their official timetables and route permits without any restrictions.

The government and police responded that no buses were being outright stopped or banned; rather, due to law and order concerns, vehicles were being organized into escorted convoys with police and levies protection when crossing between districts, especially around sunset. They pointed out that this arrangement had actually been agreed upon in a joint meeting between the bus owners' representatives and the authorities, with the schedule and timing decided by mutual consent.

The Balochistan High Court dismissed the petition, finding no evidence that authorities had issued any order banning night travel. Instead, the record showed the petitioners' own representatives had agreed to the convoy system for security reasons, and the bus owners were simply now reluctant to honor that agreement. The court held the petition baseless and ruled that security-driven convoy arrangements, agreed to by the industry itself, do not violate the owners' rights.

حکومت اور پولیس نے جواب دیا کہ کسی بھی بس کو مکمل طور پر روکا یا اس پر پابندی نہیں لگائی جا رہی، بلکہ امن و امان کی صورتحال کے پیش ن
