Dost Muhammad V. Additional Sessions Judge Barkhan at Rakhni and another,
PCrLJ 2017 1654 · Balochistan High Court
This case is about how criminal trials should be handled when key prosecution witnesses go missing. Dost Muhammad was one of several people accused in a 2012 case registered with local Levies police. During the trial, the complainant and two eyewitnesses repeatedly failed to appear despite being summoned, and it emerged that the complainant and one witness were themselves wanted, and hiding, in a separate murder case. Instead of proceeding, the trial judge accepted a request from the prosecutor to place the case "in dormant," effectively pausing it indefinitely while keeping the accused on bail without any fixed date for resuming proceedings.
Dost Muhammad challenged this before the Balochistan High Court, arguing that a case cannot simply be shelved because prosecution witnesses are unavailable, especially when other witnesses could still be examined.
The High Court agreed. It explained that under Section 344 of the Criminal Procedure Code, courts can adjourn trials for absence of witnesses or other valid reasons, but such adjournments must be recorded in writing and set for a definite, reasonable period, not left open-ended. The court held that witnesses who are themselves fugitives from the law lose the normal protection of having a case wait on their convenience, and their absence does not justify indefinite delay. The court therefore set aside the trial court's order, reinforcing that criminal trials must proceed with reasonable diligence rather than remain frozen indefinitely.
