Allah Dina V. The State ,

PCrLJ 2017 1521 · Balochistan High Court

This case involved Allah Dina, who had been convicted and sentenced for murdering a man and injuring another during a shooting incident in 2012. His conviction had already been upheld on appeal. After that, the parties reached a compromise, and Allah Dina asked the trial court to accept it and acquit him under the law allowing victims' heirs to pardon an offender.

The trial court refused to accept the compromise, finding that material facts had been hidden. On revision, the Balochistan High Court agreed with that decision and dismissed the petition.

The court found serious problems with the compromise. The deceased had six legal heirs, but the compromise was signed only by the father, a brother (who was not actually a legal heir), and a minor son around 14-15 years old, too young to give valid consent. Two other heirs, a wife and daughter, were claimed to have died, but their death certificates had been issued based merely on information given by the deceased's brother, not properly verified. Another surviving wife was said to have been divorced before the deceased's death, but no official divorce record from the Union Council was produced. It also emerged that this "divorced" wife was the convict's own sister, a fact deliberately concealed.

The court held that anyone seeking judicial relief must approach with clean hands, and that courts, as protectors of all heirs' rights, cannot ignore suppressed facts or irregularities. The petition was dismissed, keeping the conviction intact.
