The State through Regional Director/Force Commander, Anti-Narcotic Force Balochistan V. Muhammad Bakhshal and another,

PCrLJ 2017 1426 · Balochistan High Court

This case involved an appeal by the state, through the Anti-Narcotics Force Balochistan, against the acquittal of two men, Muhammad Bakhshal and Noor Muhammad. They had been travelling in a pickup truck along with the driver, Saffar Khan, when the vehicle was stopped and 102 packets of charas (a narcotic substance) were found concealed in its floor. The driver was convicted and sentenced, but the trial court acquitted the two passengers, finding no clear evidence linking them to the hidden drugs. The state challenged this acquittal, arguing that since the men were present in the vehicle and did not deny this, they should be treated as equally responsible.

The Balochistan High Court disagreed and upheld the acquittal. It noted that the two respondents had claimed from the start that they were merely hitching a ride, and the prosecution's witnesses gave no evidence showing they knew about or controlled the concealed contraband. Only the driver, as custodian of the vehicle, could reasonably be held responsible for what was hidden inside it.

The court reaffirmed important legal principles: prosecutors must prove guilt beyond reasonable doubt, any doubt benefits the accused, and acquittals carry a "double presumption of innocence" that appellate courts should not disturb unless the decision is clearly unreasonable or against evidence. Finding no such flaw here, the court dismissed the state's appeal, keeping the acquittal intact.
