Haji Muhammad Naeem V. Muhammad Younas and others,

PCrLJ 2017 1155 · Balochistan High Court

This case concerns an appeal against the acquittal of two men accused of murdering Muhammad Saleem in Pishin, Balochistan in 2011. According to the prosecution, the victim was shot by two men on a motorcycle who were then chased and arrested by Levies Force personnel. The trial court had acquitted the accused, and the victim's brother (the complainant) appealed against that acquittal to the Balochistan High Court.

The High Court examined the eyewitness testimony and found serious contradictions among the witnesses, including disagreement over where the victim died, how the Levies Force was informed, and where he was actually shot. The court also found it implausible that the witnesses, who claimed to be close relatives present at the scene, made no attempt to stop or resist the attackers. This raised doubts about whether the witnesses were truly present during the crime.

The court reiterated key legal principles: medical evidence alone cannot sustain a conviction without credible eyewitness testimony; when motive is alleged but unproven, courts must scrutinize evidence carefully; and any single reasonable doubt entitles an accused to acquittal as a matter of right, not leniency. It also emphasized that acquittals carry a "double presumption of innocence," meaning appellate courts should not interfere unless the original decision was clearly unreasonable or contrary to evidence.

Finding the trial court's acquittal well-reasoned and not arbitrary, the High Court dismissed the appeal, upholding the acquittal. This case illustrates how unreliable witness testimony can
