PCrLJ 2017 1113 · Balochistan High Court

This case involved three men convicted for smuggling large quantities of foreign liquor and beer discovered aboard a vessel intercepted near Gwadar by Customs authorities and the Maritime Security Agency. The boat had thousands of bottles and cans of whiskey and beer, and after a chase, it was searched and the contraband seized. The trial court convicted the appellants under the Customs Act for possessing and transporting smuggled goods, sentencing them to five years' imprisonment plus fines.

On appeal, the Balochistan High Court upheld the conviction itself, finding the prosecution's witnesses consistent and credible, with no contradictions or evidence of false implication, and a forensic lab report confirming the seized liquor was genuine contraband.

However, the court reduced the sentence significantly. It noted that only a small sample of the massive seizure, three bottles of whiskey and one can of beer, had actually been sent for chemical testing. The court held that an accused can only be held criminally responsible for the specific quantity that was scientifically tested and confirmed as contraband, not the entire seized stock, since without testing every portion, it cannot be presumed all of it was actually illegal liquor.

As a result, the court reduced the appellants' sentence from five years to time already served, while keeping other penalties intact. This case matters because it establishes an important safeguard: prosecutors must forensically test what they seize, and courts cannot punish someone for the full quantity of goods recovered if only a fraction was actually verified as contraband.
