Muhammad Arif V. The National Accountability Bureau through Director-General, Cantt., Quetta,
PCrLJ 2016 895 · Balochistan High Court
This case involved Muhammad Arif, who was accused by the National Accountability Bureau of participating in a fraud scheme involving fake lottery draws for cars, and specifically of using ATM cards belonging to other account holders to withdraw and benefit from proceeds of the crime, amounting to millions of rupees. He was arrested in March 2013 and had been in custody for over two years by the time this petition was filed. He asked the Balochistan High Court for bail, arguing that his trial had been unreasonably delayed and that under the law, prolonged detention without conclusion of trial should entitle him to bail.
The court rejected this argument. It held that offences under the National Accountability Ordinance are non-bailable, and the normal statutory right to bail for delay under the Criminal Procedure Code does not automatically apply to such cases. While the High Court can still grant bail using its special constitutional powers in appropriate situations, this is discretionary, not a right. Here, much of the delay was caused by the conduct of the accused's own lawyer, and the accused had earlier been a fugitive who did not cooperate with investigators. Given the strong evidence against him, the court found no justification to grant bail. Instead, it dismissed the petition and directed the trial court to hold hearings weekly and finish the trial quickly. The case highlights how accountability law limits bail rights for corruption accused, even amid delays.
