PCrLJ 2016 865 · Balochistan High Court
This case involved a stolen truck theft complaint in Killa Abdullah, Balochistan. The petitioner, Akhtar Muhammad, alleged that the investigation into his complaint (FIR No. 36 of 2014) was mishandled by the Tehsildar acting as Investigating Officer under the Levies Force. He claimed the stolen truck was never recovered, named suspects were not arrested despite being pointed out, there was an unexplained one-month delay in registering the case, and the identification parade was improperly conducted—all suggesting the investigating officer was influenced or acted in bad faith. He asked for the investigation to be transferred to the Crimes Branch.
The Additional Sessions Judge, acting as Ex-Officio Justice of the Peace, had refused this request, ruling that the special procedure under the Balochistan Levies Force Act, 2010 had to be followed first before invoking ordinary criminal procedure powers.
