Muhammad Anwar V. SHO and 2 others,

PCrLJ 2016 76 · Balochistan High Court

This case involved a father, Muhammad Anwar, whose daughter Samina was found dead at her husband's house from a gunshot wound. A murder FIR was registered, and police investigated, recovering the pistol and other evidence from the scene. Unsatisfied with how the investigation was conducted, Anwar alleged the police acted with bias, failed to properly record a confession, and did not preserve evidence properly. He asked the Additional Sessions Judge, acting as Ex-Officio Justice of the Peace, to order a reinvestigation by transferring the case to the Crimes Branch. That request was denied on the grounds that the investigation was already complete and the case had moved to trial, so reopening it would serve little purpose. Anwar then challenged this refusal before the Balochistan High Court.

The High Court dismissed the petition, ruling that Anwar had approached the wrong forum. It clarified that a Justice of the Peace only has power to order transfer of investigation before the police report is submitted and the trial court takes up the case. Once that happens, only the trial court can address concerns about evidence, missing witnesses, or forensic reports, using its powers under Section 540 of the Criminal Procedure Code. The court emphasized that the investigation process is never truly closed, since new facts can still be brought up during trial. This ruling clarifies the limited jurisdiction of Justices of the Peace and reinforces that trial courts are the proper venue for addressing investigative shortcomings once a case reaches trial.
