PCrLJ 2016 522 · Balochistan High Court

This case involved a shootout in March 2012 between security forces (Levies, Anti-Terrorism Force, and Frontier Corps) and a group of armed men in Killa Abdullah, Balochistan. During the operation, some accused allegedly opened fire, injuring a soldier and damaging a vehicle, while one of their own companions died from the crossfire. Several accused were arrested along with weapons and explosives, leading to multiple FIRs under the Pakistan Penal Code, the Anti-Terrorism Act, and the Arms Ordinance.

At trial, the Anti-Terrorism Court acquitted all the accused. The prosecution appealed this acquittal to the Balochistan High Court.

The High Court found serious flaws in how the trial was conducted. Crucially, the prosecution's Special Prosecutor had been negligent: important witnesses who had signed the recovery memos (documenting the seized weapons) were never examined in court, and the actual seized weapons and explosives (the "case property") were never produced as evidence. The trial court had ignored its power under Section 540 of the Criminal Procedure Code, which allows courts to summon material witnesses necessary for a fair decision, and failed to check whether the prosecution had presented all necessary evidence.

Because of these gaps, the High Court set aside the acquittal and sent the case back to the trial court, directing it to record statements from the recovery memo witnesses, produce the seized weapons as evidence, and let both sides present further evidence before deciding the case afresh.
