Muhammad Hanif V. National Accountability Bureau Islamabad through Chairman and 2 others,

PCrLJ 2016 1325 · Balochistan High Court

This case involved Muhammad Hanif, a former WAPDA employee, who faced corruption charges under the National Accountability Ordinance, 1999. He was accused of acquiring assets and property worth tens of millions of rupees between 1987 and 2014 that were disproportionate to his known income, allegedly with the help of a co-accused who used his own name and bank accounts to hide illicit commission payments and properties on Hanif's behalf. A formal reference was filed against him, and charges including corruption, forgery, and using forged documents were framed in April 2015.

Hanif had already sought bail multiple times before this petition. His pre-arrest bail was refused, he was arrested, and two separate post-arrest bail applications were also dismissed by the Balochistan High Court, with one appeal to the Supreme Court also failing. In this latest petition, he argued that since the trial would take considerable time to conclude, he should be granted bail.

The High Court rejected this argument, noting that he had already raised the exact same ground in an earlier bail application that was dismissed, and no new facts or developments had emerged since then. Witness testimony recorded so far had neither cleared him nor supported his release. Finding no fresh grounds, the court dismissed his petition.

This case illustrates how courts in accountability matters are reluctant to grant bail repeatedly on identical grounds, emphasizing that delay alone, without new circumstances, is insufficient to justify release in serious corruption cases.
