Nawab Khan alias Dah Khan and others V. The State and others,
PCrLJ 2015 539 · Balochistan High Court
This case involved a fight in Balochistan in which a man named Said Khan was injured, allegedly beaten with sticks and stones by four men, resulting in a fractured leg. Two of the accused, Nawab Khan and Fazal Khan, were tried and convicted by a Magistrate for causing hurt under the Pakistan Penal Code, receiving six months and two years imprisonment respectively along with fines (Daman) to be paid to the victim. Their appeal to the Sessions Judge was rejected, and the conviction was upheld. Both the convicted men and the complainant then approached the Balochistan High Court, the men seeking acquittal and the complainant seeking a harsher sentence.
The High Court examined whether there were serious legal errors or misreading of evidence by the lower courts that would justify overturning their decisions. It found that the explanation for a delay in filing the police report was reasonable and unchallenged, that family relationships among witnesses did not automatically make their testimony unreliable absent proof of bad faith, and that no major inconsistencies undermined the prosecution's case. The defense evidence had already been considered and found unconvincing.
The court therefore upheld the conviction and rejected both petitions, including the complainant's request for a harsher sentence, noting he had not raised that issue earlier before the appellate court. The judgment reinforces that revision courts should not reopen factual findings already properly considered by trial and appellate courts unless clear legal errors exist.
