Syed Bibi V. Naib Tehsildar Levies Bostan and 10 others,
PCrLJ 2015 1777 · Balochistan High Court
This case involved a mother, Syed Bibi, seeking justice for her son, Hafiz Muhammad Jan, who died during what police described as an armed encounter with Levies personnel in Bostan. Police had registered an FIR claiming Muhammad Jan and another man opened fire on a patrol, prompting a shootout in which he was killed. The mother alleged instead that her son had been tortured and killed while in police custody, not in an exchange of gunfire, and she applied to have a second FIR registered against the police officials involved. A Sessions Judge, acting as Justice of Peace, rejected her request, so she approached the High Court.
The High Court found serious contradictions in the prosecution's version, including unexplained multiple injuries and a skull wound caused by blunt force that didn't fit the "encounter" story, and the absence of any medical certificate despite claims the injured man was taken to hospital. Since the mother's account described a materially different time, place, and manner of death, the Court ruled that this amounted to a distinct version disclosing a separate offense, which legally required registration of its own FIR and investigation.
The Court set aside the lower court's order, directed police to register the second FIR based on the mother's allegations, and ordered that this new case be investigated and tried alongside the original case. This decision matters because it reinforces that when family members present a credible, conflicting account of a death involving police, courts must allow that version to be formally investigated rather than dismissed outright.
