Zia Ur Rehman V. The State,
PCrLJ 2015 1502 · Balochistan High Court
This case involved Zia-ur-Rehman, who was tried for attempted murder and causing serious injury (under sections 324 and 337-D of the Pakistan Penal Code) arising from a shooting incident outside a courtroom in Kharan in 2002, in which one person died and several others were injured.
In 2003, the trial court initially acquitted Zia-ur-Rehman of all charges while convicting some co-accused. A petition challenging that acquittal was filed, but the petitioner's lawyer explicitly chose not to pursue the case against Zia-ur-Rehman, meaning his acquittal stood. The High Court later sent the case back to the trial court, but only to have it rewrite its judgment regarding the other convicted accused, not to retry Zia-ur-Rehman. Despite this, when the case went back to the trial court, it reopened the matter against Zia-ur-Rehman too and this time convicted him of the same charges he had already been acquitted of.
The Balochistan High Court ruled this was unlawful. It held that trying and convicting someone a second time for an offense they were already acquitted of violates the legal protection against double jeopardy, found in Section 403 of the Criminal Procedure Code and Article 13 of the Constitution of Pakistan, which guarantees that no one can be punished or tried again for the same crime once acquitted or convicted. The court therefore set aside Zia-ur-Rehman's conviction and sentence and discharged his bail bonds. The case highlights an important constitutional safeguard protecting
