PCrLJ 2015 1490 · Balochistan High Court
This case involved a dispute over agricultural land in Mastung district, Balochistan. The petitioner, Abdul Haque, filed a complaint under the Illegal Dispossession Act, 2005, claiming he had been forcibly dispossessed of land he owned, that his tenants had been assaulted, standing crops destroyed, and that the respondents had illegally constructed houses on the property. The trial court dismissed his complaint at an early stage, before framing any charge, holding that the dispute was essentially civil in nature and did not amount to criminal illegal dispossession. Abdul Haque challenged this dismissal before the Balochistan High Court.
The High Court first addressed whether a revision petition was even allowed, since the Illegal Dispossession Act does not explicitly mention appeal or revision rights. The Court held that since the Act extends the Code of Criminal Procedure to its proceedings, the general right of appeal and revision under the Cr.P.C. applies, so the petition was maintainable.
On the merits, however, the Court found that the complaint lacked essential details, such as the exact area of land involved, when the alleged construction occurred, or how dispossession took place. There was no evidence the respondents were land-grabbers who forcibly seized the property. The investigation report showed only that respondents were in physical possession, which was not enough to prove criminal illegal dispossession. The Court therefore upheld the trial court's decision and dismissed the petition, emphasizing that vague allegations cannot substitute for specific proof of criminal wrongd
