Shah Jahan V. Muhammad Noor and another,
PCrLJ 2015 1482 · Balochistan High Court
This case involved a murder appeal from Balochistan High Court. Nizam-ud-Din was found dead with bullet injuries in January 2009. Initially, no one came forward to identify a suspect, and police closed the case after several months. Almost a year later, the deceased's son, Shah Jehan, applied to reopen the case, naming his own brother as the killer, claiming he and another brother had witnessed the shooting but stayed silent out of fear.
The accused brother was arrested, and police recorded a disclosure statement from him leading to recovery of a Kalashnikov rifle. The trial court acquitted him, and the complainant appealed against the acquittal.
The High Court upheld the acquittal. It found that the accused's disclosure statement and the weapon recovery were not legally significant under Article 40 of the Qanun-e-Shahadat Order, since the facts and location had already been known to police before the accused ever spoke. There was also no forensic match or recovered bullet casings linking the weapon to the crime. Crucially, the court noted the witnesses' highly suspicious behavior: as the deceased's own sons, they neither took their dying father to hospital nor informed police for nearly a year, and during cross-examination admitted that after implicating their brother, they inherited his substantial land, orchard, and cattle. This raised strong doubt about false implication, so the court dismissed the appeal and upheld the acquittal, emphasizing that courts should not disturb a well-reasoned trial court acquittal without compelling reason.
